PAYMENT
In obtaining services provided by Edify.lk and purchasing educational material, you agree to provide payment for the Products/Services in the stipulated currency and you will be liable to pay any relevant conversion charges, as well as applicable sales tax in your region. Please note that we must receive your assigned payment before providing you with access to the Products/Services.
Payments can be done through direct web access, desktop applications, mobile application services offered by us.
If you obtain any service through mobile application services, you shall be required to provide certain payment and billing information such as your credit/debit card details, paypal account information and other prescribed payment details. Upon the collection and confirmation of necessary information, the assigned amount will be deducted and you will receive your purchase according to what you chose.
We strictly follow a non refund policy with regards to all the services and products purchased.
We also reserve our right to review and change the pricing of any of our products/services. This will not affect products that have already been purchased.
OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, Edify.lk is the owner or the licensee of all intellectual property rights in our Website and/or Services (including any content made available through our Website and/or Services and the underlying source code with regards to the software that we use). These include but not limited to the Platform and all text, images, marks, logos and other Content contained herein, including, without limitation, the logo and all designs, text, graphics, pictures, information, data, software, sound files, and other files.
A User may not copy, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license, or otherwise exploit the Platform or any materials on the Site, except as expressly permitted by these T&Cs or other applicable policies. You must not delete or alter any copyright, trademark or other proprietary rights notices from copies of materials.
YOUR OBLIGATIONS
If you are a registered user, we provide you with a personal, non-transferable, non-exploitable, non-exclusive, open-ended one user license to access the Content hosted in the website only for legitimate private use purposes under the present terms and conditions.
It is expressly forbidden to use the Content for illegal purposes and/or for professional exploitation. Users may not sublicense the use of, or the access to the Platform and the services to any third party with or without remuneration. All the modifications and changes done in the website shall be notified to you via email, indicating the key changes , as required by applicable law. We do not exclude or limit our liability to you in any case where it would be unlawful to do so.
However, we are not liable to you in any way for any indirect, special, incidental, punitive or consequential damages of any character, including without limitation damages for loss of goodwill, work stoppage, computer failure or malfunction, loss of data, loss of productivity or contract or any and all other commercial damages or losses.
GOVERNING LAW & VENUE
This Agreement will be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflicts of law principles and without regard to any presumption or rule requiring construction or interpretation against the party drafting or causing any instrument to be drafted. You hereby submit to and agree that the sole jurisdiction and venue for any actions that may arise under or in relation to the subject matter hereof shall be an appropriate court located in Colombo, Sri Lanka.
